1. Introduction

F7 Software Inc ("F7 Software," "we," "our," or "us"), doing business as Arc Monitor Pro, operates the Arc Monitor Pro IoT & Reporting Platform, including web-based dashboards, IoT device management interfaces, REST APIs, and associated reporting services (collectively, the "Service"). This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you access or use our Service.

By accessing, registering for, or otherwise using the Service, you acknowledge that you have read and understood this Privacy Policy and agree to the collection, use, and disclosure of your information as described herein. If you do not agree, you must immediately discontinue use of the Service.

This Privacy Policy is incorporated into and forms part of our Terms of Service. Capitalized terms not defined here have the meanings given in the Terms of Service.

2. Information We Collect

2.1 Information You Provide Directly

  • Account registration information: name, email address, company or organization name, role, and time zone
  • Billing and payment information (processed by our payment processor; we do not store full card numbers or CVV data on our servers)
  • Communications you send to our support team or through contact forms, including attachments
  • Configuration data you enter into the platform (device names, location labels, tenant settings, shift schedules, API keys)
  • Optional profile fields and preferences

2.2 Information Collected Automatically

  • Device telemetry transmitted by IoT devices registered to your account (weld session records, arc time, sensor readings, device identifiers, firmware version, timestamps, and network diagnostics)
  • Server and application logs including IP addresses, browser type, operating system, referring URLs, pages visited, request paths, response codes, and timestamps
  • Usage analytics including feature interactions, session duration, clickstream data, and error reports
  • MQTT client identifiers and broker session metadata used for device authentication and data routing
  • Approximate location derived from IP address (we do not collect precise GPS coordinates)

2.3 Information from Third Parties

  • Authentication data if you use single sign-on (SSO) or OAuth providers
  • Payment verification, fraud, and chargeback data from our payment processors
  • Enrichment data from business information providers (optional and limited)

2.4 Information We Do Not Collect

We do not knowingly collect: biometric data, precise geolocation data, audio or video recordings, information from children under 16, or any category of sensitive personal information as defined under applicable privacy law unless you affirmatively provide it to us and consent to its processing.

3. How We Use Your Information

We use the information we collect for the following purposes:

  • To provide, operate, maintain, and improve the Service
  • To process and display IoT device telemetry and generate operational reports
  • To authenticate users and enforce role-based and tenant-based access control
  • To send transactional communications including account verification, password reset, and two-factor authentication codes via email
  • To send service-related notices, maintenance alerts, billing notices, and security notifications
  • To process payments, manage subscriptions, and collect fees owed
  • To detect, investigate, prevent, and respond to fraud, unauthorized access, security incidents, abuse, and technical issues
  • To comply with legal obligations, respond to lawful requests, and enforce our Terms of Service
  • To create anonymized, aggregated statistics that do not identify any individual or customer
  • With your consent, for any additional purpose disclosed at the time of collection

We do not use your data, nor the data generated by your devices, to train machine-learning models for the benefit of third parties, and we do not sell, rent, or trade your personal information.

4. Legal Basis for Processing

Where applicable law requires a legal basis for processing personal information, we rely on the following:

  • Contract performance — to provide the Service you requested
  • Legitimate interests — to operate, secure, and improve the Service, provided those interests are not overridden by your rights
  • Legal obligation — to comply with tax, accounting, and regulatory requirements
  • Consent — where required by law, and which you may withdraw at any time

5. Sharing and Disclosure of Information

We do not sell your personal information. We may share your information only in the following circumstances:

5.1 Service Providers and Sub-Processors

We engage carefully selected third-party vendors who perform services on our behalf, including cloud hosting, database services, transactional email delivery, payment processing, error monitoring, and analytics. These vendors are contractually obligated to process information only in accordance with our instructions and to implement appropriate security safeguards.

5.2 Business Transfers

In the event of a merger, acquisition, reorganization, bankruptcy, receivership, or sale of all or a portion of our assets, your information may be transferred as part of that transaction. We will notify you via email or prominent notice on the Service before your information becomes subject to a different privacy policy.

5.3 Legal Requirements

We may disclose your information if required to do so by law, subpoena, court order, regulatory demand, or other valid legal process, or where we have a good-faith belief that disclosure is necessary to: (a) comply with a legal obligation; (b) protect and defend our rights or property; (c) prevent or investigate possible wrongdoing in connection with the Service; (d) protect the personal safety of users of the Service or the public; or (e) protect against legal liability.

5.4 Protection of Rights

We may disclose information to protect the rights, property, or safety of F7 Software Inc, our customers, employees, contractors, or others, including enforcing our Terms and investigating security incidents.

5.5 With Your Consent

We may share your information for any other purpose with your explicit prior consent.

6. Sub-Processors and Third Parties

Arc Monitor Pro uses a limited number of sub-processors to deliver the Service. Current categories include: cloud hosting and infrastructure providers, transactional email providers, payment processors, MQTT broker hosting, and error-reporting services. We maintain commercially reasonable contractual safeguards with each sub-processor and may change sub-processors from time to time. A current list is available upon written request to [email protected].

7. Data Retention

We retain personal information for as long as necessary to provide the Service and fulfill the purposes described in this policy, unless a longer retention period is required or permitted by law (for example, for tax, accounting, fraud prevention, or legal compliance purposes).

  • Account data: retained for the duration of your subscription plus up to 90 days after termination
  • IoT telemetry: retained for the period specified in your subscription plan; historical data may be archived in anonymized form
  • Billing records: retained for a minimum of seven (7) years to comply with tax and audit requirements
  • Security and access logs: retained for up to 24 months for security investigations
  • Backups: residual data may persist in secure backups for up to 90 days after deletion from production systems

Upon account termination, we will delete or anonymize your active data within 90 days, except where retention is required by applicable law or necessary to resolve disputes and enforce our agreements.

8. Data Security

We implement commercially reasonable technical and organizational measures designed to protect your information against unauthorized access, alteration, disclosure, or destruction. These measures include:

  • Encrypted data transmission using TLS for web traffic and MQTT over TLS for device connections
  • Encrypted data storage at rest for sensitive fields, including hashed passwords and hashed API keys
  • Role-based and tenant-scoped access controls
  • Optional two-factor authentication via email or authenticator app
  • Periodic security assessments and dependency monitoring
  • Least-privilege access for employees and contractors
NO METHOD OF TRANSMISSION OVER THE INTERNET OR METHOD OF ELECTRONIC STORAGE IS 100% SECURE. WHILE WE USE COMMERCIALLY ACCEPTABLE MEANS TO PROTECT YOUR INFORMATION, WE CANNOT GUARANTEE ABSOLUTE SECURITY. YOU USE THE SERVICE AT YOUR OWN RISK AND ARE SOLELY RESPONSIBLE FOR MAINTAINING THE CONFIDENTIALITY OF YOUR ACCOUNT CREDENTIALS AND API KEYS.

9. Your Rights and Choices

Depending on your location, you may have the following rights regarding your personal information:

  • Access: Request a copy of the personal information we hold about you
  • Correction: Request that we correct inaccurate or incomplete information
  • Deletion: Request that we delete your personal information, subject to legal retention obligations
  • Portability: Request that we provide your data in a commonly used, machine-readable format
  • Opt-out of marketing: Unsubscribe from marketing communications at any time using the unsubscribe link
  • Restriction or objection: Request that we restrict or stop processing your information in certain circumstances
  • Withdraw consent: Where processing is based on consent, withdraw consent at any time (without affecting the lawfulness of processing prior to withdrawal)
  • Lodge a complaint: File a complaint with your local data protection authority

We may require reasonable verification of your identity and the authority of any agent acting on your behalf before processing requests. We reserve the right to decline requests that are manifestly unfounded, excessive, or that would infringe the privacy rights of others.

10. Cookies and Tracking Technologies

We use cookies and similar technologies (including local storage and session tokens) to maintain your signed-in session, remember your preferences, secure the Service against cross-site request forgery, and analyze aggregate usage. Cookies we set are categorized as:

  • Strictly necessary: required for authentication, session management, and security (cannot be disabled)
  • Functional: remember preferences such as time zone and UI settings
  • Analytics: help us understand aggregate usage patterns (no cross-site advertising)

You may control cookie preferences through your browser settings. Disabling strictly-necessary cookies will prevent the Service from functioning. We do not use third-party advertising cookies, and we do not participate in cross-site behavioral advertising networks.

11. Children's Privacy

The Service is designed for business and industrial use and is not directed to or intended for individuals under the age of 16. We do not knowingly collect personal information from children. If you believe we have inadvertently collected information from a child, please contact us immediately at [email protected] and we will promptly delete it.

12. International Data Transfers

The Service is operated from and hosted in the United States. If you are accessing the Service from outside the United States, please be aware that your information will be transferred to, stored, and processed in the United States (and possibly other jurisdictions where our sub-processors operate), where data protection laws may differ from those in your jurisdiction. By using the Service, you consent to this transfer, storage, and processing.

Where we transfer personal data from the European Economic Area, the United Kingdom, or Switzerland to the United States, we rely on appropriate safeguards such as the European Commission's Standard Contractual Clauses and applicable supplementary measures.

13. California Privacy Rights (CCPA/CPRA)

California residents have additional rights under the California Consumer Privacy Act (CCPA) as amended by the California Privacy Rights Act (CPRA), including:

  • The right to know the categories of personal information collected, sources, purposes, and recipients
  • The right to delete personal information we have collected, subject to legal exceptions
  • The right to correct inaccurate personal information
  • The right to opt out of the "sale" or "sharing" of personal information (we do not sell or share personal information as those terms are defined by the CCPA/CPRA)
  • The right to limit the use of sensitive personal information (we do not use sensitive personal information for purposes requiring a limit-use option)
  • The right to non-discrimination for exercising your privacy rights

To submit a request, contact us at [email protected] with "California Privacy Request" in the subject line. We will verify your identity before responding. You may also designate an authorized agent to submit a request on your behalf, subject to verification.

14. European Privacy Rights (GDPR / UK GDPR)

If you are located in the European Economic Area, the United Kingdom, or Switzerland, you have additional rights under the General Data Protection Regulation (GDPR) and the UK GDPR, including the rights of access, rectification, erasure, restriction, portability, and objection as described in Section 9. You also have the right to lodge a complaint with your local supervisory authority.

For the purposes of the GDPR, F7 Software Inc is the data controller with respect to the personal information of individual account holders, and a data processor with respect to end-user data processed on behalf of a business customer. Where we act as a processor, processing is governed by the written agreement between us and the business customer.

15. Do Not Track Signals

Some browsers transmit "Do Not Track" signals. Because there is no industry consensus on how to interpret these signals, the Service does not currently respond to Do Not Track signals. We do, however, honor all other opt-out mechanisms described in this Privacy Policy.

16. Security Breach Notification

In the event of a data security incident affecting your personal information, we will notify you and any applicable regulatory authorities as required by applicable law, generally without undue delay after we become aware of the incident. The notification will include the nature of the incident, the categories of information affected, the likely consequences, and the measures we are taking or have taken to address the incident.

17. Changes to This Policy

We may update this Privacy Policy from time to time to reflect changes in our practices, technologies, legal requirements, or other factors. When we make material changes, we will notify you by email (sent to the email address on your account) or by posting a prominent notice on the Service. The "Last Updated" date at the top of this policy indicates when it was most recently revised. Your continued use of the Service after the effective date of an update constitutes your acceptance of the updated policy.
